Layer for spatial check to determine if exempt single family docks are eligible for SPGP VI through the self-certification e-application
<DIV STYLE="text-align:Left;"><DIV><DIV><P><SPAN>Since DEP assumed CWA section 404 permitting authority in certain state waters, it can only grant federal authorization via the State Programmatic General Permit (SPGP VI) in waters that are retained by the Corps for permitting under CWA Section 404 or Section 10 of the Rivers and Harbors Act. This layer combines the Consolidated Retained Waters Guideline and Historic Commerce Waters layers (with a 100ft buffer added to the latter) to check if dock locations indicated through the ESSA single family dock self-certification application can be granted SPGP.</SPAN></P></DIV></DIV></DIV>
